Lawsuit Filed Against OpenAI and Sam Altman
Florida Attorney General James Uthmeier filed a lawsuit on Monday against OpenAI and its CEO, Sam Altman, alleging the company knowingly released an unsafe product. The civil action, filed in Florida’s tenth circuit, accuses OpenAI of negligence, violating product liability laws, and engaging in deceptive and unfair trade practices.
The lawsuit claims that OpenAI failed to warn users that ChatGPT could be dangerous, instead marketing the tool as safe and reliable. According to the 83-page complaint, the company's actions were driven by an "insatiable quest to win the AI arms race".

The complaint details a wide array of alleged harms resulting from the use of ChatGPT. Specifically, the lawsuit claims that mass shooters have been "aided and abetted in deadly rampages" and that vulnerable individuals have been encouraged to commit suicide.
Beyond violent incidents, the filing alleges that the tool has caused minors to become addicted to a system that "feigns human compassion" to collect data without parental oversight. The lawsuit further asserts that professionals have suffered public humiliation and that users have experienced a loss of critical thinking skills.
Personal Liability for Sam Altman
A central component of the legal action is the attempt to hold Sam Altman personally liable for damages. Attorney General Uthmeier stated that the suit seeks to hold Altman accountable for "reckless and willful conduct" and an "utter disregard for the risk to human life caused by his firms’ conduct".
During a press conference on Monday, Uthmeier said, “Sam Altman and ChatGPT have chosen the AI race over the safety and security of our kids. They have chosen profit over public safety, and we’re not going to stand for it here in Florida”.
Legal Context and Ongoing Investigations
This civil action is separate from a criminal investigation into OpenAI that Uthmeier opened in late April, which remains ongoing. The civil suit seeks penalties and a court order rather than criminal charges.
OpenAI is not the only AI firm facing legal challenges regarding safety. More than 20 lawsuits have been filed against OpenAI over alleged harms stemming from ChatGPT. Additionally, Character.AI recently settled multiple lawsuits brought by families who claimed its companion chatbots contributed to mental health crises and suicides among children and teenagers. In response to those issues, Character.AI has barred users under 18 from creating or interacting with chatbots.
